Abstract

The issue of whether the imposition of local government planning schemes under the Integrated Planning Act 1997 (Qld) (IPA) is valid under the Native Title Act 1993 (Cth) (NTA) is analysed. It is suggested that the lack of recognition of native title rights and interests in native title lands by the IPA would make it invalid as a future act under the NTA.
